Capcom accused of ripping of ‘Splosion Man

In the video game industry, it’s not uncommon for developers to take ideas that worked for high profile games and try to make them work for their own games. Sometimes they work, other times the results are not pretty. Then there are times when a developer takes not only another’s game ideas, but creates an exact copy of that game using those ideas and calling it their own.

A new game popped up on the App Store yesterday by the name of MaXplosion. The game is described as: �a pick up and play platformer in which protagonist Max has "the ability to explode at will allowing you to bounce off surfaces and reach far flung locations". If this sounds familiar, that’s because it bears uncanny resemblance to Twisted Pixel’s hit platformer ‘Splosion Man.

"MaXplosion gameplay video makes me sad. If you're going to outright steal a game, you should at least understand what makes it fun. Never thought I'd see the day when the 'exploding man' genre was overcrowded," he added. "Borrowing is great. Hell, we do it all the time. But that game is a complete theft." said Mike Henry, a programmer for Twisted Pixel, on his Twitter.

Michael Wilford, co-founder and CEO of Austin based Twisted Pixel, and someone the site has interviewed before, had this to add on his Twitter: "Just sux bc we're 2 small to do anythng about it, & I bet Capcom's countng on that. I'll always love Capcom bc of what they brought to my childhood, but WTF have they turned into? First they lose Inafune, now this #itsashame. Best part is, we originally pitched @Splosion_Man to Capcom and they said no. Not sure what to say about MaXplosion, Pisses me off. Guess we're just gonna have to make a better iPhone game than them. Shouldn't be hard."

When considering in pursuing legal action against the Japanese developer Wilford had this to say in a statement with Joystiq: "We're definitely not going to pursue legal action. While I think the similarities are pretty nauseating, we're too small to take on a company like Capcom. That, and we owe them one for inventing Mega Man, so we'll let them slide. I just hope they're not counting on the fact that indies can't fight back. In general, anything that would take our focus off of making games would be a bad decision, I think. We just need to keep our heads down making the next thing so that Capcom has something to steal next year. But I have to say, the amount of support we've seen in the last 12 hours on Twitter and over email has been awesome, and I think that's better than wining [sic] a stupid lawsuit or anything like that. We'll just have to make our own mobile game and I'm hopeful that Capcom will see that robbing our shit wasn't worth it in the long run. We'll let you know when we have something on the mobile front to talk about, but now we have added incentive!"

There’s a saying that goes �imitation is the sincerest form of flattery�. If that’s true then the act the obvious lifting of an indie game by Capcom from Twisted Pixel must mean that they’re in love with the indie developer. Hopefully this matter brings some regulation on IP protection and copyright for indie developers.
