Don't be a jerk while streaming Black Ops II or Treyarch will ban you

Treyarch has posted their Security & Enforcement policy for Black Ops II on the official Call of Duty forums.  Among the standard rules of not being an ass while playing the game online to the various bannings you will receive if breaking said rules, but a new set of rules has been added involving streaming Black Ops II:

Offensive Live Streams or Unauthorized Live Stream Content

Any user who is found to have offensive or unauthorized content in their live stream is subject to penalty. Offensive content includes but is not limited to foul language, racially charged language, and nudity. Unauthorized content includes but is not limited to unlicensed music, TV shows, movies and brand logos.

  • Minor offense: User will be temporarily banned from using live streaming and may have camera streaming privileges in the game revoked.
  • Extreme or repeat offenses: User will be permanently banned from using live streaming.
  • Extreme offenders will also be reported to the live streaming service provider and may have their account revoked by that service provider.

This is, safe to say, an interesting precedent put forth by Treyarch.  Yesterday, news came out that Black Ops II will feature YouTube streaming built into the game which would seem to be reason enough to develop these rules.  However, regarding the point regarding "Extreme offenders will also be reported to the live streaming service provider and may have their account revoked by that service provider" appears to be a bit of a stretch of the powers as a developer. 

Twitch.tv, the preferred site to stream video game content for many gamers, has its own policies regarding what behavior is and isn't accepted, as do other streaming sites.   What if someone is streaming via Twitch, cursing up a storm, but doing it without talking to other players online or maybe they're talking to their friends on Skype?  If unauthorized content includes brand logos, will someone be banned if they have a Nike shirt on while on cam while streaming the game?

It's understandable that Treyarch wants to make their game to be in the best light possible, but reaching out to other service providers, that they have no direct relation with, and enforcing their policies onto that service provider, is very questionable.
